Stephen S. Herst counsels states and businesses with escheat/unclaimed property matters and assists with administering state unclaimed property programs, including the State of Delaware’s Voluntary Disclosure Agreement (“VDA”) program for unclaimed property compliance. He advises clients regarding state unclaimed property laws in mergers and acquisitions, with gift card management issues, and with securities-related unclaimed property regulatory compliance, working with issuers, transfer agents, broker-dealers, and mutual fund companies.
Steve also represents startup, early stage, and emerging growth companies with commercial contracts, including business formation and operation, corporate governance, and intellectual property-related agreements. Additionally, he has experience resolving commercial matters in Delaware’s state and federal courts and before state agencies.
Steve previously clerked for the Honorable Resident Judge Richard R. Cooch for the Delaware Superior Court, interned with the Honorable Leonard P. Stark for the U.S. District Court for the District of Delaware, and served as a special assistant to U.S. Senator Thomas R. Carper of Delaware.
