Philadelphia Labor & Employment partner Dan Aiken's article, “Take Care When Recruiting from the Competition” was published in The Society for Human Resource Management (SHRM).

Dan’s article provides useful tips for employers who want to hire employees with post-employment restrictive covenants, as well as creative strategies to avoid legal repercussions.

Dan states that an employer should assess the business impact of the restriction; review and analyze the true legal risk; (such as the likelihood that the former employer will take legal action, and whether they would succeed if they do); proceed carefully with the intended hire; and protect your company from the beginning by establishing ground rules in writing during the interview process, and follow through to make sure the potential hire fully complies with those rules.
