Washington, D.C., partner Jesse Witten wrote an article for Law360 titled “Why the Supreme Court Decided to Hear King v. Burwell.” The article discusses the Supreme Court’s decision to review a Fourth Circuit decision upholding a regulation by the IRS that permits the government to subsidize health insurance on federally created exchanges, as well as health insurance purchased on a state-created exchange.

“The Supreme Court’s decision will answer the significant question of whether the federal government is authorized to subsidize health insurance purchases on federal exchanges by the residents of the 34 states that have not created their own exchanges, a question that will dramatically affect the implementation of the ACA in those 34 states,” says Jesse.
