Retail employers are no doubt already aware of the California Court of Appeal’s November 2010, opinion in Bright v. 99 Cents Only Stores, Inc.  The case is a timely reminder of the “suitable seating” requirement of the California Industrial Welfare Commission’s Wage Order 7 and has already engendered multiple collective actions across the state -- including cases against Walgreens, Ralphs, and Trader Joe’s -- filed earlier this week in Los Angeles Superior Court, and against Safeway Stores, Inc. filed a few days before in Alameda Superior Court in Northern California.
