A new interim final rule published by the Department of Commerce, Bureau of Industry and Security (BIS) will result in significant changes for most companies that export commercial encryption items – articles, technical data or software – from the United States.  The goal of the new rule, published in the Federal Register on June 25, 2010, is to streamline export controls as they apply to encryption items by modifying the Export Administration Regulations (EAR) to change the definitions of items subject to the controls of Category 5, part 2, as well as the requirements of the most commonly used License Exception for those items – License Exception ENC.  The new rule makes a number of important changes that should reduce the burden of compliance for most companies.
