Over the past six months, importers and domestic manufacturers have been struggling to understand and comply with the Consumer Product Safety Improvement Act (CPSIA). The Act became law on August 14, 2008, and has been a major challenge for both small and large companies, not only in interpreting the provisions, but also in implementing practices and procedures to ensure compliance. By far, the biggest challenges are the sections of the Act that cover children’s product safety. The scope of the provisions cover the lead ban, phthalates prohibition, mandatory third-party testing, tracking labels, mandatory toy safety standards and label requirements for advertising.
