Labor & Employment partner Kate Gold and associates Phil Lebel and Irene Rizzi were featured in a Q&A for Bloomberg’s FLSA Litigation Tracker. “Litigators Review the Year’s Top Employment Law Issues, Discuss What to Expect in 2018” focuses on the latest updates on the Fair Labor Standards Act (FLSA) salary threshold, the overtime rule and what it means for employers, and litigation tactics for FLSA cases.

Kate, Phil and Irene state that they anticipate the possibility of a lower salary threshold, and that once a new rule has been issued, “employers should be prepared to evaluate the exemption status of their employees and reclassify employees and/or adjust wages, as needed.” They also discuss Perry v. Randstad and its impact on defense counsel’s use of DOL opinion letters, as well as Cortez v. Doty Bros. and the use of arbitration agreements. The article concludes with Kate, Phil and Irene’s brief overview of other labor and employment law developments litigators and employers should be aware of.
