Washington D.C. partner Laura Phillips was quoted in a Law360 article titled, “FCC’s Municipal Broadband Loss Cuts Off Policy Options.” The article discusses the Federal Communications Commission’s recent Sixth U.S. Circuit Court of Appeals loss over its efforts to promote expanded municipal broadband. The court ruled that the FCC lacked authority to pre-empt state laws on offering broadband access.
Laura explains that the Chairman of the FCC saw circumstances that “cried out for remedy” and the agency took its best shot. She expects the FCC to engage with House leadership on competition issues next year, as the pressure for Communications Act rewrites will likely grow.
