Philadelphia partner Michael Daly participated in a panel discussion at the Beard Group’s Class Actions Conference on May 7, 2018.  The panel—titled “Plaintiffs Placing Themselves in Harm’s Way”—explored the questionable ethics and effectiveness of intentionally incurring harm in order to pursue claims in class actions. Whether such plaintiffs can establish that they have standing to pursue their claims, let alone the ability to adequately represent the interests of others, has become an increasingly important question as this has become an increasingly common tactic in cases under the TCPA, FCRA, and similar statutes that provide for statutory damages.

The Beard Group’s annual Class Actions Conference brings together practitioners, professors, and other class action professionals to discuss the many economic and ethical considerations in class actions. Professor Samuel Issacharoff, Kenneth Feinberg, Elizabeth Cabraser, and many other thought leaders in the class action arena also participated in the day-long conference.
