Philadelphia partner Richard Coe and Wilmington partner Todd Schiltz spoke at The Legal Intelligencer’s In-House Counsel CLE Seminar on December 6. The panel, titled “Protecting the Privilege: Best Practices for Invoking the Attorney-Client Privilege and Work Product Doctrine,” focused on privilege issues relevant to even non-litigators, such as issues that arise in compliance-related internal investigations, mergers and acquisitions, and audits. Among other things, the presenters addressed recent NLRB challenges to confidentiality instructions given during internal investigations and in severance agreements. They also used hypotheticals to illustrate some of the complicated privilege issues that may arise before litigation is anticipated.
