Philadelphia associate Debora Plehn-Dujowich moderated an AIPLA CLE webinar titled, “Association for Molecular Pathology v. Myriad Genetics: Navigating the Isolated DNA Patent Eligibility Jungle,” on Wednesday, July 24.

Debora moderated a panel comprising Gregory Castanias of Jones Day, who argued the case for Myriad before the Federal Circuit and also before the Supreme Court, Professor Joshua Sarnoff, who wrote an amicus brief on behalf of 15 law professors in support of the petitioners, and Manny Vacchiano from Life Technologies.

The panelists discussed the implications of the Supreme Court's opinion, which held that isolated DNA in not patent eligible subject matter, but that cDNA may be patent eligible subject matter under certain circumstances.  The panelists also discussed the implications of the decision for the patent eligibility of other naturally occurring products, such as proteins and antibodies, as well as the implications of the decision for diagnostics.
