In recent years, the risks faced by U.S. exporters have grown significantly as the U.S. Government has increased both its enforcement activities and the potential penalties for violations of export control laws and regulations. As a result, many companies subject to U.S. export jurisdiction are revisiting their compliance policies and practices to ensure that they adequately address these new risks. Joan Koenig in Drinker Biddle’s Customs and Trade Practice will discuss "best practices" to promote compliance with U.S. export control laws and regulations. In addition, because violations occur even at companies that follow best practices, she will also address the factors that governmental agencies consider in making penalty determinations and the types of controls that can be vital to avoiding or minimizing these penalties in the event of a violation.
