Overview

John Fogarty assists clients in preparing and litigating employee benefits matters. He gives clients confidence through all aspects of the litigation process and has experience in both federal and state courts. Additionally, John counsels plan administrators and fiduciaries on benefit claim administration, claim review procedures, fiduciary governance, COBRA compliance and benefit plan design.   

Prior Experience

Before joining Faegre Drinker, John served as an associate at an AmLaw 100 firm in ERISA litigation where he represented Fortune 500 companies in federal and state court. In that capacity, he was responsible for developing litigation strategies and budgets, as well as handling pleadings, motions, discovery and reporting directly to clients. 

John also served as a judicial clerk in the U.S. District Court for the District of Maine for the Hon. Judge Lance E. Walker, and as a judicial clerk in the Superior Court for the State of Maine. He also spent time as a student attorney at the Cumberland Legal Aid Clinic where he represented indigent clients 

John worked as a legal intern at a Fortune 500 company, gaining experience with the in-house team and working on employment and employment benefit law, ERISA litigation, insurance law, alternative dispute resolution, IP law and privacy law. 

Additionally, John worked with Local 19 Sheet Metal Workers Union in Philadelphia as a Peggy Browning Fund Legal Fellow.
