Clients turn to our litigators for their deep experience with complex insurance issues spanning property and casualty, life insurance, annuities, long-term care and professional liability cases.
We advise clients on exposures stemming from viaticals, life settlements and non-recourse premium financing, and act as national secondary market counsel to many leading life insurance providers on stranger-originated life insurance (STOLI) transactions. Our clients include life insurers, broker general agents, broker dealers, escrow agents and premium financing companies.
Our team of lawyers has handled hundreds of disputes in state and federal courts, leveraged our vast network of local counsel contacts, and developed highly experienced client and trial teams to address the many novel issues triggered by insurance industry litigation.
Members of our team have led or co-chaired the compliance track of the Intercompany Long Term Care Insurance conferences, meaning that we take an active leadership role in planning the five to eight compliance focused sessions at that annual conference. We have presented one or more sessions at each such conference over the past ten years, including within the compliance, underwriting, and claims tracks.
We are just as involved in the Long Term Care International Forum, with members of our team having served as president of the organization (2009–2010, 2010–2011), a member of the board of directors (2011–Present, term to expire 2015), secretary (2011–Present), and members of the program committee (2009–Present). We have presented one or more sessions at the LTCIF annual conference for each of the past eight years.
We also actively participate in other conferences that address LTCi issues and regularly participate in meetings of the Senior Issues Task Force of the National Association of Insurance Commissioners.
We provide a wide range of litigation services to the insurance industry including:
We have more than two decades of experience representing life insurance carriers in misrepresentation, conditional receipt, policy lapse and other complicated coverage disputes. These cases often involve policies with high face amounts and allegations of bad faith and unfair claims and trade practices. For many carriers we are the “go-to” firm for pre-litigation analysis of complex claims.
Our firm has a premier national practice in the arena of annuities, including litigation ranging from suitability class actions to rapidly evolving structured settlement litigation. We have handled hundreds of such disputes in state and federal courts, leveraging our vast network of local counsel contacts, and have developed highly experienced client and trial teams to address the many novel issues triggered by these cases.
We have served as national counsel in many high-profile cases. A number of these cases involved aggregate exposures in the billions of dollars, and, as these cases continue to evolve, our lawyers have been at the forefront. For many carriers we also regularly provide counsel on important coverage issues outside of a litigation context.
We have a depth of experience successfully defending LTC insurers in dozens of coverage actions for more than 15 years. We have successfully resolved numerous LTCi class actions and many individual claims and other lawsuits. Over the last 10 to 15 years, we have had multiple LTCi lawsuits and other engagements running at all times.
