We have represented accountants and lawyers in professional services liability cases nationwide. Our group has deep experience providing ethics counseling to law firms. We regularly provide expert testimony and have served as court appointed experts in connection with professional service litigation. While our legal malpractice trial attorneys are well versed in the litigation management requirements of today’s insurers, a substantial part of our professional liability defense work involves direct representation of national and regional law firms. We assist clients with corporate matters including contracts and license negotiations between professional services firms and their vendors, clients and partners. This includes mergers and acquisitions, intellectual property rights, complex tax issues and other matters.
Our group assists clients with negotiating, drafting and implementing deferred compensation and equity compensation arrangements. We help clients with employee benefits and executive compensation issues such as negotiation of severance agreements, as well as issues that arise in mergers and acquisitions and the sales of businesses. We also work on ERISA issues that arise in connection with the investment of money held by employee benefit plans and individual retirement accounts in mutual funds and other investment entities. Our clients include national and international corporations, banks, insurance companies, mutual funds and other investment entities, utilities, transportation companies, hospitals, governmental units, schools, universities, churches and other nonprofit organizations. Labor and Employment
Our group provides businesses with a full range of employment-related legal services including employment counseling, training, union, labor and management relations and litigation. We represent employers in court and regulatory proceedings involving current and former employees and have experience litigating class actions and employment discrimination, retaliation, harassment and wrongful termination claims based on race, sex, sexual orientation, religion, national origin and other statutorily-protected characteristics. We have also handled numerous wage and hour, breach of contract, severance, employee benefits, non-competition, confidentiality, trade secret, whistleblower, invasion of privacy and defamation claims.
Information Privacy, Security and Governance
Our group advises clients on privacy and data security measures, including state and federal requirements on internal data maintenance. We assist clients in a variety of industries with information governance policies, privacy and data safeguards, compliance programs, data migration and classification and technology consulting. We work with clients to develop information governance frameworks to effectively link information creation and use to business objectives. We categorize information during its useful life and defensibly and securely dispose of it when it is no longer needed. We also help clients respond to data breaches and establish policies to prevent future data breaches.
Professional Services Liability
Our group has represented large accounting firms, smaller firms and individual accountants in securities litigation, malpractice claims, other sorts of litigation and administrative proceedings. We have also represented some of the nation’s largest law firms in complex, high-exposure cases involving claims arising from the conduct of trials, real estate transactions, private employment matters, fee disputes, commercial transactions and bank representations. We counsel law firms on ethics issues and have also provided expert testimony and served as court appointed experts in connection with professional service litigation. Our professional services liability group includes the former chairman of the American Bar Association’s Section of Litigation and its Standing Committee on Ethics and Professional Responsibility, members of the American College of Trial Lawyers and New Jersey Supreme Court Certified Civil Trial Attorneys.
