Our lawyers have broad experience in the criminal antitrust realm. We have represented clients from diverse industries (from production of commodities to highly specialized goods and services) in investigations and prosecutions brought by antitrust authorities in the United States, Canada and the European Union. We have defended U.S. and non-U.S. clients, both corporate and individual, against allegations of bid rigging, price fixing, market allocation, customer allocation, monopolization and other forms of alleged anticompetitive conduct. Our lawyers have handled all phases of antitrust investigations and prosecutions, including advising clients served with search warrants, grand jury subpoenas and other requests for production of documents, negotiating leniency and amnesty arrangements, counseling witnesses and subjects in connection with grand jury proceedings and representing our clients at trial. We also have substantial experience representing clients in related civil litigation, brought by class plaintiffs, opt-out plaintiffs, indirect purchasers and others.

These representations include:

    • Persuading the Department of Justice to decline prosecution of large privately-owned construction companies in connection with a criminal investigation into allegations of bid rigging on USAID-funded construction projects in Egypt;
    • Securing immunity for a marketing executive in connection with the prosecution of individuals alleged to have conspired to fix prices and allocate customers in the textile industry;
    • Representing non-U.S. sales executives in class action litigation arising out of an alleged conspiracy to fix prices and allocate customers in the vitamins industry;
    • Securing declination of prosecution on behalf of the former CEO of a joint venture that was the subject of an Antitrust Division price-fixing investigation of the elastomers industry;
    • Obtaining closure of an Antitrust Division price-fixing investigation of the oil and gas drilling services industry on behalf of a marketing executive for a leading manufacturer of ceramic proppants; and
    • Obtaining closure of an Antitrust Division price-fixing investigation on behalf of a senior executive for a leading manufacturer in the automobile paint industry.
