Federal Preemption. The federal regulatory framework for the wireless industry poses both opportunities and challenges in litigation. Our knowledge and experience with this framework helps us counsel clients on issues such as state regulatory incursions into the federal domain or assertion of federal preemption of state law claims in asserted class actions. Often we consult on federal regulatory issues in litigation matters begun by other firms. We provide counsel to national wireless companies as they face increasing efforts by state and municipal governments to impose localized regulatory requirements in areas reserved to the federal government under the federal communications laws. We also represent wireless carriers in state interconnection arbitrations, rulemakings, and other proceedings involving state regulation in areas traditionally reserved to the states. Commercial Litigation.
