Business disputes – disputes arising out of corporate transactions, equity and debt financings, supplier and customer relationships, and contracts for commercial loans, sales, licensing and employment, to cite just a few examples – are the bread and butter of our business and finance litigation practice. We bring a wealth of experience to such engagements along with a commitment to understanding your business and working closely with you to achieve a successful result.
We handle complex commercial disputes coast to coast for manufacturing concerns, pharmaceutical companies, health care providers, professional service firms, financial services businesses, information services businesses and technology companies, ranging in size from small family businesses to Fortune 100 companies. Some recent engagements include:
- We represented a major accounting firm in an arbitration and related litigation arising from a decision to resign from the audit of a public company. The former audit client sought more than $50 million in damages. The proceedings included 25 days of testimony over 12 months, with hundreds of pages of briefing. Our client was vindicated on all points.
- We represented an entity that oversees the investment and disbursement of oil development revenues for the benefit of Alaska residents in a lawsuit over the ownership of a Philadelphia office building valued at more than $80 million. Our client’s right of first refusal to buy the building from its investment partners was challenged. After preliminary injunction proceedings and an expedited appeal to the Court of Appeals, the matter settled very favorably for our client.
- We have represented defendants from a range of industries in class actions asserting contract and consumer protection claims. Our class action, mass tort and multidistrict panel experience includes state and federal courts in Pennsylvania, New Jersey, Illinois, New York, Delaware, West Virginia, Washington, Texas, Tennessee, Mississippi, Michigan, Kentucky, Louisiana and many other jurisdictions.
With every client, we approach litigation as a business matter: analyzing options, identifying costs and risks, recommending effective approaches, and helping you choose among alternatives. We assess cost-effective approaches, both in the courts and through arbitration, mediation and other alternative dispute resolution approaches. (We are a charter sustaining member of the CPR Institute for Dispute Resolution.) We work closely with you to manage resources and costs.
The ability effectively to try cases, however, is the backbone of any effective litigation strategy. As trial lawyers, we have been regionally and nationally recognized for our accomplishments in litigating significant commercial disputes. Our appellate lawyers are equally highly regarded. We can help you address your business litigation problems at any and every stage of the process.
