New Trends in Misclassification Cases

L&E Practice co-chair and San Francisco partner Cheryl Orr wrote an article for Inside Counsel titled, “New Trends in Misclassification Cases.”

Cheryl notes that “In 2012, misclassification lawsuits have burgeoned in new states, new industries and new areas of focus.”  She discusses how such suits are moving beyond California and New York; how the financial, insurance, pharmaceutical and retail industries are still the hardest hit but no sector is immune and how Plaintiffs are focusing on the misclassification of independent contractors and interns in particular. 

Cheryl emphasizes that  all employers should engage in “regular and thorough audits to minimize risks and properly record best practices” To be “prepared whatever the trends.”
