IRS Commences Community Benefit Compliance Check Initiative

Tax and Health Law Client Memorandum

For several months, the Internal Revenue Service (“IRS”) has indicated its intent to undertake a “compliance check” regarding the community benefit activities of tax-exempt hospitals. IRS officials have stated that, using an approach similar to that used in the 2005 initiative regarding executive compensation, the IRS will be contacting approximately 600 hospitals across the country with inquiries regarding their community benefit activities and compensation practices. Various hospitals across the United States
have received compliance check questionnaires (IRS Form 13790) and are now considering whether and how to respond.
