Patrick Kelleher concentrates in the trial and appeal of complex federal matters, primarily under the patent and antitrust laws. His experience representing Asian, European, Canadian and U.S. clients in both civil and criminal matters spans the electronics, health care, pharmaceutical, energy and aeronautics industries. He is currently the co-chair of the firm’s IP Litigation Team.

Patrick represents parties in patent infringement suits concerning apparatus, design and method (including business method) patents. He has represented and counseled clients in connection with antitrust claims, internal corporate investigations and investigations by the Federal Trade Commission and the U.S. Department of Justice. He has been retained several times as new counsel for appeal and, for example, has won reversal of a $20 million antitrust jury verdict.

Patrick has argued before numerous courts, including the U.S. Court of Appeals for the Federal Circuit and the Supreme Court of South Dakota.  In a recent case, he obtained summary judgment of noninfringement for a major manufacturer of cell phones and also Rule 11 sanctions against opposing counsel with an award to our client of attorney fees.  In his most recent case before the Federal Circuit, the court affirmed a judgment in favor of our client a mere five days after oral argument. He has obtained many favorable summary judgments, verdicts and appellate results, including a rare writ of mandamus to protect a client's attorney-client privilege, and has represented clients in more than 25 states. His cases have twice reached the U.S. Supreme Court.

He is active in the ABA's Antitrust Section. He is now chair of the AT-Daily Digest Committee and was previously vice chair of the Computer & Internet Committee, and vice-chair of the Business Torts Committee.  In 2001-2002, he served as assistant to the Section's chair.

Immediately before the combination of Drinker Biddle and Gardner Carton & Douglas, Patrick served as co-chair of GCD's Litigation Department and as a member of the firm's Operating Committee. Before joining the firm, he served as law clerk to the Hon. Paddy H. McNamara in the Law Division of the Circuit Court of Cook County and worked in the Frauds Bureau of the District Attorney of New York County (Manhattan). Patrick is a dual citizen of the United States and Ireland.
