Joseph N. Schmidt, Jr. assists clients with all aspects of environmental regulatory compliance issues and the environmental implications which result from business and real estate transactions. He has more than 30 years of experience in evaluating and minimizing risks relating to New Jersey and federal environmental regulatory compliance and transactional issues.
Joe has guided many companies and individuals to cost-effective solutions as they maneuver through the maze of complex federal, state and local environmental statutes and regulations. His top priority as an environmental lawyer is serving as a problem solver for his clients.
In private practice since 1986, he has extensive experience in all aspects of environmental regulatory, due diligence, site remediation and permitting issues, including the Site Remediation Reform Act, Industrial Site Recovery Act, Brownfields redevelopment, underground storage tanks, water, solid and hazardous wastes and other environmental programs. He advises clients concerning environmental issues which arise as part of various land use matters including providing advice on wetlands, stormwater management and other related issues.
Prior to going into private practice, he was senior staff attorney with the New Jersey Department of Environmental Protection in Trenton, N.J. During his tenure at NJDEP, Joe worked on the initial implementation of the Environmental Cleanup Responsibility Act (the predecessor statute to the Industrial Site Recovery Act) and other significant New Jersey environmental statutes.
Joe has successfully resolved and closed hundreds of ISRA and New Jersey site remediation cases for clients. He has assisted clients in understanding complex environmental issues during the due diligence phase of transactions and drafted environmental provisions that protect the client from present and future environmental liability. Joe is adept at working with NJDEP and other governmental regulatory agencies in moving a client’s issues and projects to a good outcome. He helps clients work with their Licensed Site Remediation Professional or “LSRP” in order to achieve an expedited and cost-effective remediation of New Jersey contaminated sites. Basically, Joe is a problem solver who helps his clients resolve their environmental issues with a steady hand and an eye towards a cost-effective, practical solution.
