Kevin devotes a significant amount of his practice to advising life insurance carriers on issues, including those relating to the secondary market for life insurance, premium financing, fraud, and stranger-originated life insurance (STOLI). Kevin has represented a number of those clients in bringing successful declaratory judgment actions seeking to have STOLI policies declared void ab initio, resulting in the successful voiding of over $22 million in coverage. He also recently counseled four carriers through the criminal prosecution of several STOLI promoters whose actions had victimized those clients. Kevin also prepared a former company executive to testify as a government witness in that action.
Kevin has also litigated a broad range of commercial disputes including a products liability action, coverage disputes, and breach of contract actions.
Kevin frequently provides advice to clients with regard to issues impacting their businesses nationwide, and has appeared on behalf of his clients before federal and state courts in Arizona, California, Colorado, Delaware, Florida, Georgia, Maryland, Michigan, New Jersey, Pennsylvania, and West Virginia. Kevin regularly provides his clients with guidance on attempted assignments of structured settlement rights, tax issues, estate issues, garnishment and child support issues, overpayments and collection efforts, commutations, minors' issues, bankruptcy, workers' compensation issues, and interpleader actions.
Kevin has also successfully defended his clients from exposure over the alleged failure of their individual and group annuity products. In addition, Kevin has provided his clients with advice on commission splitting issues and litigation.
