Darren S. Cahr counsels clients and litigates disputes on topics relating to trademarks and branding, advertising claims, copyrights, social media, product design, trade secrets, marketing practices and promotion law. He has provided critical advice to many of the nation’s largest companies on their most important marketing needs, and has argued cases in courts around the nation and before administrative agencies, dispute resolution forums and self-regulatory bodies. Darren also serves as chair of the firm's Advertising and Promotions Team.

Darren’s practice is directed to assisting clients in better understanding the value of their intangible assets and developing tactics to capitalize on their value. To that end, Darren creates branding and enforcement strategies, investigates the misappropriation of proprietary rights, reviews advertising and promotions for compliance with regulatory standards, and works with clients to address the complex issues that arise with the use of social media and leading-edge communications platforms.

Darren is a widely published author on topics of law, politics and popular culture, a novelist, a musician, and a theorist on topics of social media, popular culture and technology. He posts at a blog on social media and intellectual property, and through Twitter @legallysocial. He regularly speaks on issues involving new media and intellectual property throughout the country and around the world.

  • Successfully argued appeal overruling trademark application refusal in In re Johnson & Johnson, Serial No. 85286071 (T.T.A.B. 2015)
  • Won complex product configuration trade dress infringement action at trial, upheld on appeal, in Bobrick Washroom Equipment v. American Specialties (C.D. Cal. 2012)
  • Successfully obtained consent judgments in parallel importation cases in Trademark Holdings of Illinois v. AR Dental (E.D. NY 2009) and Trademark Holdings of Illinois v. King’s Two Dental Supply (C.D. Cal. 2009)
  • Won high-profile copyright infringement action relating to protection of science fiction tropes in films and video games in Crawford et al. v. Midway Games Inc., et al, 2:07-cv-00967 (C.D. Cal. 2008)
  • Successfully tried trademark infringement action, upheld on appeal, Vincent v. City Colleges of Chicago, 04-cv-07641 (N.D. Ill 2007) (aff'd, 7th Cir. 2008)
