Justin C. Linder is an associate in the Commercial Litigation Practice Group.  A substantial portion of Justin’s practice is dedicated to representing nationally-recognized companies in contract disputes and complex business litigation.

Justin also represent s clients in a variety of environmental matters, and recently completed a five-month trial in New Jersey Federal Court involving CERCLA cost recovery and contribution claims asserted against an adjacent landowner. In addition to researching and briefing a wide variety of CERCLA-related issues, Justin drafted numerous pre-trial motions, including two Daubert motions; argued a Daubert motion before the court; and prepared expert and fact witnesses for their trial testimony. He has also represented a manufacturer in an environmental dispute involving potential CERCLA contribution claims by a joint defense group of PRPs and responded to requests for information served by state environmental agencies.

Justin also defends clients in various communications litigation matters. He currently represents a leading wireless communication service provider in disputes with present and former distribution agents and customers.

As a member of the Justice Stewart B. Pollock Environmental American Inn of Court, Drinker Biddle’s Sustainability Team, and the Boston College Energy and Environment Alumni Network, Justin avidly follows and attends seminars related to developments in energy law including: renewable energy power purchase agreements; the EPA green house gas rulemaking process prompted by the seminal Massachusetts v. EPA decision; renewable energy project financing; the FERC rulemaking process and how FERC regulation of wholesale electricity markets and transmission can encourage or hinder energy efficiency and renewable energy generation; the New Jersey Regional Greenhouse Gas initiative; the New Jersey Energy Master Plan and the various renewable energy incentives programs provided under New Jersey law; federal initiatives and proposed statutes aimed at encouraging energy efficiency and renewable energy production. During law school, Justin authored a detailed memorandum relating to renewable energy production tax credits available under the American Jobs Creation Act of 2004 and Energy Policy Act of 2005. The memorandum provided a survey of available incentives and was utilized by a municipality seeking to install a wind turbine for the purpose of calculating the maximum tax credits attainable to offset costs.

In the international realm, Justin advised a team of Belgian attorneys in an estate dispute involving application of New York substantive law. His assistance enabled them to obtain a favorable judgment permitting their client to introduce DNA of the decedent's relative to dispute the adverse party's right to inheritance.

Justin is also active in pro bono work and represented an elementary school child who sought the full implementation of his Individualized Education Plan. He also recently attended a comprehensive education law seminar focusing on rights conferred to special needs students under state and federal law.
