Philadelphia and Princeton associate Vik Jaitly published an article in the Drinker Biddle LaborSphere blog titled, "Employers Should Not Rely on Employer Handbooks to Create Enforceable Arbitration Agreements." The article discussed the New Jersey Appellate Division's recent published opinion, which held that an arbitration clause in an employee handbook was unenforceable because the handbook also contained standard disclaimer language stating that the handbook did not create an employment contract.
