The Adviser's Duty of Loyalty
Fred Reish and Joan Neri co-authored an article for PLANADVISER magazine discussing the duty of loyalty of a fiduciary adviser under ERISA. Specifically, the article explains that the legal duty of a fiduciary adviser runs directly to the participants and this duty overrides any duty the fiduciary adviser may have to the plan sponsor.
