Moorad Sports Law Journal (formerly the Villanova Sports and Entertainment Law Journal) argues that even if National Basketball Association Commissioner-Elect Adam Silver is unable to retain the current contraction provision in the next collective bargaining agreement with the National Basketball Players Association, courts are unlikely to construe contraction as a mandatory subject of collective bargaining.
