Philadelphia partner Scott Coffina wrote an article for The Legal Intelligencer titled, “Where Things Stand With Regulating ‘Dark Money.’”
The article discusses the influence of “dark money” from tax-exempt “social welfare” organizations, the vague regulatory standards under which they operate, and the recent effort by the IRS to tighten its regulations. .
Scott believes that the proposed IRS regulations would infringe on free speech, and suggests that the IRS should focus instead on greater transparency. “Perhaps the IRS would be better served to emphasize transparency rather than attempting to stifle speech and get itself out of the business of regulating political activity, for which it seems about as well-equipped as regulating the nation’s health care system.”
