Philadelphia associate Todd Hutchison wrote an article for the ABA’s Young Lawyer Division, Antitrust Law Committee Newsletter titled, “The Privilege Against Self-Incrimination in the Antitrust Context.”

In the article, Todd discusses the Fifth Amendment’s privilege against self-incrimination and how the privilege is also available in civil matters, but with a significant distinction ‒ there may be certain consequences for the party benefiting from the witness’s invocation.
