Washington, D.C. counsel Katherine E. Armstrong was quoted in a Bloomberg BNA article that discusses how business and technology groups are beginning to support the federal appeals court arguments regarding how the FTC has exercised its data security enforcement action authority.

Katherine said that these concerns about the FTC’s authority to regulate cybersecurity and to bring administrative actions against companies are nothing new. She explained: “The FTC’s authority is not limitless which is why it has sought legislation to strengthen its existing data security authority and has requested civil penalty authority, jurisdiction over non-profits, and general rulemaking authority.”
