Washington, D.C. partner and Chief Data Scientist Bennett B. Borden was quoted in a Legaltech News article titled, “Balance in All Things: The Path to Preservation Excellence.” The article discussed the challenge of efficient and responsible data preservation and the importance of ensuring the data required is available while disposing of that which may be irrelevant or risky.

Bennett discussed the importance of preserving data. “Failing to preserve data that falls within the scope of discovery is the leading cause of sanctions and other adverse consequences, some of which can be quite severe,” he said. “When the duty to preserve is triggered by, for example, the filling of a complaint, parties must move quickly to identify and preserve potentially relevant data. Many times organizations will fail to act quickly enough to prevent the loss of data by the normal operations of the IT systems or the application of IT policies. This can be devastating to a party.”
