Theodore M. Becker joined Drinker Biddle & Reath LLP on April 17, 2013 in Chicago as a partner in the firm’s Employee Benefits and Executive Compensation Practice Group. He will serve as Chair of the firm’s National Employee Benefits and ERISA Litigation Team adding depth and breadth to the 40-lawyer, full-service employee benefits team.

This is the second high-profile lateral addition to the firm’s Chicago office this year, as the firm announced the addition of former Assistant U.S. Attorney and Mumbai terrorist prosecutor Dan Collins in February.

Becker focuses his practice on the representation of corporate plan sponsors and ERISA plan fiduciaries in litigation matters and regulatory agency investigations. He has represented some of the nation’s largest plan sponsors. He has successfully defended health care companies and insurers in ERISA cases and in other matters involving breach of fiduciary responsibility, improper plan termination, denial of benefits, securities fraud and unfair competition. Becker has particular experience in litigation involving employee stock ownership plans (ESOPs) and has handled some of the leading cases involving such plans.

“Ted is one of the country’s premier ESOP litigators and will be a terrific addition to both our growing ERISA litigation practice and our national commercial litigation practice,” said Howard J. Levine, chair of the firm’s national Employee Benefits and Executive Compensation Practice Group.

In addition to his ERISA practice, Becker represents clients in a variety of industries in a wide range of legal disputes, including business, contract and corporate disputes, civil rights, consumer law, employment law, false advertising, financial services, hospitality, health care, intellectual property, real estate, retail, RICO, securities, unfair competition and workouts. For many years, he has represented national and international franchisors in a wide variety of industries, including the hotel, food, restaurant, automobile and tool industries, in litigation involving franchisees, distributors and dealers.

Becker is an active member of the Legislative and Regulatory Advisory Committee of the ESOP Association and has published numerous articles and delivered many speeches on legal issues of interest relating to ESOPs. He has also been recognized for his commitment to pro bono work, including his successful representation of a nonprofit educational institution that resulted in a $3 million finding against an executor of an estate who had breached his duty by diverting funds that had been willed to the organization.

Becker earned his law degree, summa cum laude, from Northwestern University where he also earned a doctorate and master’s degrees. He earned his bachelor’s degree, summa cum laude, from Washington University. Additionally, he taught at Yale Law School where he was a Russell Sage Fellow, and he was also a Fellow of the Northwestern University Program in Law and the Social Sciences.
