In the article titled “Firing Employees Who Refuse Flu Shots Has Hidden Risks,” Mark noted that while hospitals are understandably concerned with protecting patients, visitors and employees from contracting the flu, there are certain legal liabilities inherent in disciplining or discharging employees who do not get a flu shot.

Mark discussed considerations arising from the National Labor Relations Act, considerations related to disability and religious discrimination, and guidelines for hospitals who wish to create a flu vaccination policy.
