Philadelphia partner Michael P. Daly presented a webinar titled “Statutory Damages in Class Action Litigation” on April 6, 2017.

Michael joined other noted panelists in discussing the persistent problem of class actions that seek statutory damages for technical violations of arcane or obscure statutes that cause no actual harm to the named plaintiff or anyone else. The topics discussed included the genesis and evolution of “gotcha” class actions, the inferiority of class actions that seek statutory damages that are grossly disproportionate to any actual damages, recent rulings regarding mootness and constitutional and statutory standing, and potential remedial legislation and rule amendments.
