Washington, D.C. associate Anand Shah moderated a panel session on “Active Cyber Response: Fad, Fantasy, or Fundamental Right?” at the Georgetown Cybersecurity Law Institute in Washington, D.C., on May 26, 2016. The panelists debated the use of active defense, including the underlying technical, policy, and legal issues of such a defense. They also reviewed use cases in the private sector; discussed the technical realities of using cyber weapons; and examined the effect of reforms to the Computer Fraud and Abuse Act, as well as the emergence of international norms and the implications of information sharing under the Cybersecurity Act of 2015.
