Drinker Biddle hosted a CLE breakfast briefing titled “Cybersecurity and Litigation Risk” on December 5 at the firm’s Philadelphia office.  Florham Park partner Paul Nittoly moderated the discussion which included Chicago partner Ken Dort and Philadelphia partner Ron Sarachan on the panel.

Due to the rise in cyber threats, litigation has become a rapidly growing part of that risk.  The panel discussed ways organizations can protect themselves from data breaches and from litigation.  They also explored recent litigation arising from data privacy incidents and breaches, and actions all companies should take to limit their exposure.  Specifically, the panel addressed:

  • Specific areas of vulnerability most likely to lead to litigation;
  • Legal obligations and business ramifications associated with these data breaches;
  • Recent government enforcement actions and private civil litigation; and
  • Actions companies can take today, and in some instances are legally required to take, to reduce the likelihood and impact of a data breach and better position the company should it become involved in litigation.
