Los Angeles partner Fred Reish presented, “DOL Activity: Proposed Regulations, Investigations and Evaluations of Broker-Dealers," during a webinar sponsored by the FSI Compliance Council and the FSI Ops/Tech Council on Tuesday, November 5.  

Plan sponsors have begun their analyses of 408(b)(2) disclosures, including the evaluation of compensation of financial advisers and broker-dealers. Many broker-dealers are making a number of changes in anticipation of the upcoming fiduciary advice proposal.

Fred addressed the following issues for broker deals: preparing their advisors for anticipated fiduciary regulation; how to review their 408(b)(2) disclosures within the context of DOL changes; and how to review their practices to comply with the DOL’s current investigatory practices.
