San Francisco managing partner Steve Selna, counsel Fey Epling and associate Beth Arnese presented at the Association of Corporate Counsel’s (ACC) “Deal or No Deal 3.0 – Contracts Gone Wild!” CLE program and sponsor expo on Thursday, Nov. 1, in Burlingame, California.

The program was ACC San Francisco’s largest and most attended full-day CLE event, with over 450 in-house counsel and law department personnel in attendance.

Steve, Fey and Beth presented “Drafting Arbitration Agreements Post-Concepcion:  Your ‘Get Out of Court Free’ Card?” The presentation noted that despite the intense focus on arbitration agreements since the Supreme Court’s ruling in Concepcion, the law is still not completely settled in California. 

The presentation included a brief history and background of arbitration leading up to Concepcion; the cases responding to that case and the response by California courts; and how to draft arbitration agreements so as to give the best chance of keeping claims out of court.
