Philadelphia partner Daniel Monaco was featured as panelists at the Delaware Valley Chapter of the Association of Corporate Counsel's IP Committee “A Morning of CLE” Conference in King of Prussia, PA, on May 17.

Dan delivered a one-hour presentation entitled “New Challenges to U.S. Patents under AIA - Strategies and Considerations,” which focused on the provisions and implications of new procedures available under the America Invents Act, including ex parte reexamination, supplemental examination, post-grant review, and inter partes review, which can be used to challenge patents in the Patent and Trademark Office as an alternative to litigation in district court. 

The program provided attendees with the basic elements of those new procedures and compared and contrasted them with conventional litigation.  

The presentation included Steve Benjamin and Marilyn Bromels from DuPont's legal department, who presented the viewpoint of in-house legal counsel and gave their thoughts on what patent owners should be doing to prepare for these new procedures, which begin to take effect in September.
