Why Family Law and Estate Planning Attorneys Should Collaborate for Prenups

Private client partner Lisa Presser and associate Brian Balduzzi coauthored an article for the New Jersey Law Journal that discusses the importance of collaboration between attorneys and their clients when planning prenuptial agreements.

Presser and Balduzzi note that changes in marital status can impact a family’s estate planning in important ways. They provide an overview of prenuptial agreements, explaining that they generally offer assurance for individuals and families to plan and protect significant assets in the case of divorce or death.

The authors also cover 1) defining “separate property” and “marital property,” 2) inheritance and interest in trusts, 3) planning for death, 4) applicable state law and 5) ethical practice and concerns.
