Bill Horwitz Comments on Wage and Hour Rules During Winter Storms With SHRM

In “Winter Storms Bring Flurry of Wage and Hour Questions,” the Society for Human Resource Management (SHRM) turned to labor and employment counsel Bill Horwitz for his commentary on wage and hour rules that apply to nonexempt and exempt employees during winter storms.

Horwitz noted that the Fair Labor Standards Act allows the employer to charge the missed days to vacation time if the exempt employee has time available and that the accrued paid time off may be reduced in full- or partial-day increments.

“Before requiring exempt employees to use their accrued time off, an employer should check with counsel regarding applicable state and local laws,” Horwitz added.
