Our Employee Benefits and Executive Compensation Practice Group is one of the largest in the nation. Our size and resources allow us to provide solutions to the full range of employee benefits challenges facing our education clients, including colleges, universities and nonprofit and governmental organizations.

Our labor and employment lawyers provide advice and guidance to our education clients on compliance with employment-related laws and legal requirements. Our focus is to develop realistic, proactive approaches that limit our clients’ legal exposure, and meet their business and operational objectives.

Our practice includes all aspects of qualified and nonqualified retirement plans; health, welfare and fringe benefit plans; specialized employee benefits issues under the Internal Revenue Code and ERISA; executive compensation; employee benefits-related litigation; and investment adviser and fiduciary issues. Because of their distinct treatment under the Internal Revenue Code and ERISA, tax-exempt and nonprofit organizations face different benefit-design challenges than for-profit organizations. We have a prominent tax-exempt practice, and our experience in dealing with the special concerns of these organizations is far reaching. We have a long history of working closely with our nonprofit university clients in the employee benefits area.

Labor and Employment

We provide strategic advice and counseling as specific workplace issues arise, including disciplinary matters, employment entitlements of individual employees and harassment investigations. Many of our clients are subject to affirmative action obligations based on their government contracts and subcontracts and we are experienced in drafting and reviewing affirmative action plans and in representing clients with regard to Office of Federal Contract Compliance Programs audits.

We advise clients with respect to union-related matters, serving as primary spokespersons in labor negotiations and providing counsel concerning the negotiation, interpretation and administration of labor contracts. In addition, we work closely with clients to develop union avoidance strategies for those who are not unionized and wish to maintain that status.
